terms & Conditions
These Terms and Conditions (“Terms”) govern the agreement between Sunstate Pro Painting (“we,” “us,” or “our”) and the client (“you” or “your”) for painting and related services. By engaging our services, you agree to these Terms. These Terms are published on our website: www.sunstatepropainting.com.au.
1. Contract
A written contract must be in place before commencement of any project in accordance with Queensland laws, including for projects over $3,300 as required under the Queensland Building and Construction Commission Act 1991 (QBCC Act).
2. Validity of Quotation
All quotations are valid for 90 days from the date of issue.
If the validity period overlaps with 1st January or 1st July, the quoted price may be adjusted to reflect CPI+ increases.
Acceptance of quotations is subject to credit approval.
3. Payment Terms
10% deposit is payable before commencement.
Invoices are payable within 3 days of the invoice date.
Progress claims may be issued weekly or fortnightly, depending on the project.
Work may be suspended if invoices are overdue.
Late payment fees:
Initial penalty of 5% of the outstanding amount.
Interest at 3% per month on overdue balances.
Administration fee of $220.
Payment must be made on time, regardless of delays outside our control.
4. Variations & Extras
Any additional works requested must be approved by both the client and our Project Manager.
Variations will be quoted and agreed upon prior to commencement.
5. Compliance & Licensing
We hold the following registrations and insurances:

6. Scope & Exclusions
All works will be completed as per the signed contract, quotation, or approved variations. Any verbal discussions or assumptions are not binding unless confirmed in writing.
7. Working Hours
Standard working hours: Monday to Friday, 7 am – 5:00 pm.
Work outside standard hours may incur additional charges.
8. Workplace Health & Safety
We will identify hazards and notify you if action is required.
When working within 3 metres of mains power connections, isolation by a licensed electrician is mandatory. We can arrange this at a cost of $275 (incl. GST).
9. Pre-existing Hazardous Materials
Removal or preparation of toxic coatings, asbestos, lead, or chromate-based paints will attract additional charges.
Rust treatments are limited, and no warranty applies as rust is a substrate issue.
10. Weather Conditions
Work may be postponed if weather conditions are unsuitable for application or compromise safety and warranty requirements.
11. Access Requirements
You agree to provide:
Access to all areas requiring painting.
Access to water, power, and storage space for equipment and materials.
Safe access to internal areas, roof spaces, or balconies as required.
12. Application
Application methods (brush, roller, spray) are at our discretion unless otherwise agreed in writing.
13. Colours
Final colour selections must be confirmed at least 7 days prior to project commencement.
If colours are not provided, we will match existing colours to the best of our ability.
14. Coats & Coverage
All quotations include 2 coats as standard.
If the chosen colours have poor coverage, additional coats may be required at extra cost (labour + paint).
15. Warranties
Warranties on workmanship and materials are provided where specifications are documented and agreed.
Manufacturer product warranties apply in accordance with supplier terms.
16. Clean-up & Waste Removal
We will remove paint-related debris and waste where possible. However, complete removal of all debris cannot be guaranteed.
17. Surface Preparation
Loose and flaking paint will be scraped or sanded to a sound surface.
Bare areas will be spot-primed.
Minor cracks or holes will be patched.
Exclusions: gapping under weatherboards or VJ boards unless specified (this voids manufacturer warranties).
18. Government Charges & Levies
If new government charges, levies, or taxes are introduced during the project, these may be added to or deducted from the project cost.
19. Client Responsibilities
You are responsible for:
Moving personal and valuable items before work begins.
Seeking clarification of any unclear details.
Providing written notification of any concerns or specific areas of focus.
Arranging removal/reinstallation of fixed screens, grills, shade sails, or other attachments.
Pruning trees or plants to allow safe access.
Acknowledging that while we take care when moving items, we accept no responsibility for damages to items not moved by you.
20. Retention & Liquidated Damages
We do not accept retention funds or liability for liquidated damages unless specifically agreed in writing.
21. Do & Charge / Hourly Works
Hourly rate work is available by agreement.
Rates differ for normal hours and after-hours.
Rates exclude materials and access equipment.
22. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in accordance with Queensland jurisdiction.
